- Consideration should be given to whether there will be a need to divulge confidential information belonging to either the University or the sponsor during the negotiation/application stage and if so, whether a confidentiality agreement is necessary to protect this information. An appropriate confidentiality agreement can be provided by the Research Contracts Officer.
- As soon as it has been confirmed that the contract research will proceed, steps should be taken to ensure that the appropriate contracts are put in place. In order for this to be arranged the information listed below should be supplied to the Research Contracts Officer as soon as possible.
- A copy of the Project Application or detailed information on the nature of the project and the work to be undertaken by the University;
- If the sponsor has its own standard contract that will be used in relation to the research project a copy of that contract;
- Identification of existing Intellectual Property which will be contributed by:
(a) the University;
(b) the Sponsor; and
(c) Third Parties. In the case of (c) copies of agreements which allow the use of the intellectual property for the research project should be supplied;
- Identification of the intellectual property which is likely to arise from the research project and whether it is likely to have commercial applications;
- Identification of the type of publications which are likely to arise from the research project and whether the sponsor will require restrictions on those publications for the purposes of protecting intellectual property;
- An indication of whether there are any students involved in the research; the extent to which the research results will incorporate student?s work; whether the sponsor has agreed to the student?s involvement; and details of any agreements that have been reached with the student/sponsor regarding the intellectual property arising from the student?s work;
- An indication of whether the research is integral to more long term research being conducted by the University and whether the results of the research are likely to be incorporated into the teaching programs of the University;
- An indication of whether the budget has incorporated overheads as required by University policy and if overheads have not been included, details of reasons and approvals obtained (see Guidelines for Commercial Research and Related Activities and Sections 4.51 and 4.52 Handbook of Administrative Information);
- An indication of whether the work is to be carried out solely by University employees and students or whether consultants will be used or some or all of the work will be sub-contracted to outside parties (see policy on Engagement and Use of Outside Consultants in the Handbook of Administrative Information);
- An indication as to whether there is a likelihood of a conflict of interest arising in undertaking the research (see
Procedures for the Conduct of Research - Handbook of Administrative Information).
